Foreclosure Is Not Your Only Path

Five Ways Forward When The Payment No Longer Works

Most homeowners who call me think they have one option. Usually they have three or four. The right one depends on your hardship, your equity, your loan type, and how much time is left on the clock.

The Short Answer

A short sale is when your lender agrees to accept less than you owe so the home can be sold and the loan released. In Virginia, it is usually less damaging than a foreclosure, lets you control the timeline, and can include a written waiver of the remaining balance. It only works if you start before the trustee sale date.

01

Loan Modification

The lender changes your rate, term, or balance so the payment fits. Best when your hardship is temporary and you want to keep the home.

02

Forbearance Or Repayment Plan

A pause or reduced payment for a set time, then a plan to catch up. Useful for short-term setbacks like a job gap or medical leave.

03

Short Sale

You sell for less than you owe with the lender's approval. You control the process, avoid a foreclosure on your record, and negotiate the deficiency.

04

Deed In Lieu

You hand the deed back to the lender in exchange for releasing the loan. Faster than foreclosure, but rarely approved when there is a second mortgage.

05

Traditional Sale

If you still have equity, a well-priced regular sale may beat every option above. Fredericksburg-area values have climbed. Check before you assume.

I Have Sat At A Lot Of Kitchen Tables Like Yours

During the housing crash of the mid-2000s, I spent years doing the unglamorous work of short sales and foreclosure avoidance. Hardship letters. Second-lien negotiations. Mortgage insurers. Broker price opinions. Lenders who lost the same file three times. I learned what gets approved, what gets ignored, and how to keep a buyer at the table while the bank takes its time.

Today I teach other agents how to handle distressed sales the right way. When you work with me, you get that experience directly, not a script.

Why Local Matters Here

The Fredericksburg region has its own pressure points. Long I-95 commutes. Federal and contractor jobs tied to DC budgets. Military families near Quantico and Dahlgren who get orders on short notice. Rate resets, rising insurance, and HOA increases in subdivisions from Lee's Hill to Embrey Mill. I know how those situations read to a lender, and how to present yours honestly and effectively.

No Judgment. Ever.

Hardship happens to good people. Divorce, illness, job loss, a business that slowed down. My job is not to grade your situation. It is to give you clear choices and a plan.

The Process

How A Short Sale Works With Me

Six steps. Plain English. You always know where the file stands.

01

Confidential Conversation

We talk through your loan, your hardship, your timeline, and any sale date. No pressure and no cost to have the conversation.

02

Options Review

We compare a short sale with modification, deed in lieu, or a regular sale. I will refer you to a housing counselor, attorney, or CPA when that serves you better.

03

Build The File

Hardship letter, financials, and the lender's forms. A complete package is the single biggest factor in how fast a lender responds.

04

Price And Market It Right

Priced to what the lender's valuation will support, marketed as subject to lender approval, so we attract buyers who will wait.

05

Negotiate With The Lender

I handle the follow-up, the valuation, second liens, HOA balances, and the deficiency waiver language. You stay informed without living on hold.

06

Close And Move Forward

Approval letter reviewed, settlement scheduled, keys handed over. Then we talk about your path back to owning again.

Know The Clock

Virginia Foreclosure Moves Fast

Virginia is mostly a non-judicial state. When the deed of trust includes a power of sale, the trustee can sell the home without going to court. That is why waiting is the most expensive decision you can make.

Month 1

A Payment Is Missed

Late fees and calls from the servicer begin. This is the best time to call me. Every option is still on the table.

Months 2 To 4

Default And Acceleration Notices

The lender sends delinquency and breach letters. Federal servicing rules generally prevent a first foreclosure filing until the loan is more than 120 days delinquent, which is the window to apply for loss mitigation.

At Least 60 Days Before Sale

Notice Of Trustee Sale

For owner-occupied homes, Virginia requires written notice of the sale at least 60 days in advance, plus newspaper advertisement. In our area, notices typically run in The Free Lance-Star.

Sale Day

Trustee Auction

The home is auctioned, often at the local circuit courthouse. Virginia generally has no right to redeem the home after the sale, and the lender may pursue any remaining balance.

After The Sale

Accounting And Possession

The trustee files an accounting of the sale. Tenants in a foreclosed rental are generally entitled to at least 90 days' notice under federal law.

Side By Side

Short Sale Vs. Foreclosure Vs. Deed In Lieu

The headline difference is control. With a short sale, you are the seller. With a foreclosure, things happen to you.

Signs It Is Time To Call

You do not have to be behind to start a conversation. Some of my best outcomes started with a homeowner who saw it coming.

  • You have missed a payment, or know you will soon.
  • You received a letter mentioning default, acceleration, or a trustee.
  • Your payment jumped from an adjustable rate, taxes, or insurance.
  • A job loss, federal job change, PCS order, divorce, or medical issue changed your income.
  • You owe close to or more than the home is worth.
  • You have a second mortgage, HELOC, or HOA balance that complicates a sale.
  • You hold a security clearance and need to resolve this before it becomes a bigger problem.

Start Gathering These Now

Lenders review short sales on paper. A complete, organized file moves faster. Here is what nearly every servicer asks for.

  • Two most recent mortgage statements for every loan
  • Two months of checking, savings, and other account statements
  • Last two pay stubs for every borrower, or a profit and loss statement if self-employed
  • Two years of federal tax returns
  • A recent utility bill
  • Your hardship letter (I will help you write it)
  • A monthly income and expense worksheet (I will provide it)
  • Any letters from your lender, trustee, HOA, or attorney
Frequently Asked

Short Sale And Foreclosure FAQs

The questions Fredericksburg-area homeowners ask me most.

What is a short sale in Virginia?

A short sale is a sale where the lender agrees to accept less than the full loan balance as payoff. You list and sell the home like any other, but the contract is subject to lender approval. The lender reviews your hardship, finances, the offer, and its own valuation before signing off.

How long does foreclosure take in Virginia?

Virginia is one of the faster foreclosure states because most deeds of trust allow a non-judicial trustee sale. Owner-occupants must get at least 60 days' notice before the sale. From the first missed payment, the whole process typically takes about four to eight months, sometimes less.

Is a short sale better for my credit than a foreclosure?

Both are serious credit events. A short sale is generally viewed as less severe, and it usually shortens the wait before you can qualify for a new conventional mortgage, often four years instead of seven, or two years with documented extenuating circumstances.

Will I still owe money after a short sale?

Possibly. Virginia allows lenders to pursue a deficiency, the gap between what you owed and what the sale paid. A key part of my negotiation is getting the approval letter to state that the remaining balance is waived. Never assume. Read the approval letter carefully before closing.

Do I have to pay taxes on forgiven mortgage debt?

It depends. The federal exclusion for forgiven debt on a primary residence expired for debt forgiven after 2025 unless an arrangement was in writing beforehand, and Congress has considered extending it. Insolvency and other exceptions may still apply. Talk with a CPA and review IRS Publication 4681.

What does it cost me to work with you on a short sale?

In most short sales, the real estate commission and approved closing costs are paid out of the sale at settlement as part of the lender's approval. Sellers typically do not pay me out of pocket. We will review exactly how it works for your loan during the consultation.

Can I do a short sale if I am not behind on payments yet?

Sometimes. Some lenders will review a short sale for a current borrower with a documented hardship, such as a relocation or income loss. Others want to see delinquency first. Never stop paying on purpose without understanding the consequences. Let's look at your lender's rules first.

I already have a foreclosure sale date. Is it too late?

Not necessarily, but the clock is tight. Lenders may postpone a sale for a complete short sale package with a signed contract, though they are not required to. Call me immediately, and consider speaking with a Virginia attorney about your rights. Days matter here.

What if I have a second mortgage, HELOC, or HOA balance?

Very common, and very manageable. Every lienholder must agree to release its lien, so I negotiate with each one. Junior lienholders usually accept a modest payoff from the first lender's approved amount. HOA and condo balances also need to be addressed at settlement.

I am active duty or hold a security clearance. Does that change anything?

It can. The Servicemembers Civil Relief Act provides additional foreclosure protections for many servicemembers, and VA-backed loans come with their own assistance. Clearance holders should address financial trouble early and transparently. I work with many families connected to Quantico and Dahlgren.

Do I need an attorney for a short sale?

Not always, but often it is wise, especially with a pending sale date, a bankruptcy, a lawsuit, or a deficiency concern. I am not an attorney and do not give legal advice. I will happily coordinate with yours or point you to legal aid resources below.

Which areas do you serve?

I focus on the City of Fredericksburg, Spotsylvania County, and Stafford County, including Lee's Hill, Massaponax, Salem Church, Embrey Mill, Aquia Harbour, and North Stafford, and I work throughout the surrounding region with Coldwell Banker Elite.

Watch For Foreclosure Rescue Scams

  • Never pay an upfront fee to anyone promising to save your home. Federal rules generally ban advance fees for mortgage relief services.
  • Never sign over your deed to a third party who promises you can rent it back and buy it later.
  • Never stop talking to your lender because someone told you to.
  • Be wary of guarantees. Nobody can guarantee a lender's approval. Including me.
